Terms of use
These terms are an agreement between you and OuterMark Group Pty Ltd, which runs LocalGoingRate. By using the site, asking for a quote or signing up as a pro, you agree to them. Please read section 13: it says disputes go to individual arbitration, not court or class actions.
1. Who can use it
LocalGoingRate is for people and businesses in the United States. You must be 18 or older. If you use it for a business, you promise you can agree to these terms for that business.
2. Prices are estimates
Every price on this site is an estimate from public sources at the date shown. It is not a quote, an offer, or professional, legal or financial advice. Your real price depends on your home, the job, local permits and the contractor.
3. We connect, we don't do the work
We are not a contractor. We don't do, supervise or guarantee any work, and the pros who contact you don't work for us. They are independent businesses that pay us for leads or a listing. We don't check their licenses, insurance, bonds or reviews. Before you hire anyone, check their license with your state, get a written quote, and pull any permits your city needs. Any deal you make is between you and the pro.
4. Asking for a quote
Asking for a quote is free, and you don't have to hire anyone. When you tap the button, you agree to these terms and to calls and texts about your job from us and from up to 2 local pros, at the number you gave. Texts may be sent using automated technology. Msg & data rates may apply. Reply STOP to any text from us to stop, and tell any pro to stop and they must. You don't have to agree to texts to buy anything.
Give your own name and a number you're allowed to use. Don't ask for quotes for anyone else without their permission, and don't send fake requests.
5. Texts
Our texts follow our SMS terms, which are part of these terms.
6. For pros: who can sign up
You must be a real US business, 18 or older, and hold every license, registration, bond and insurance policy your trade, state and city require. You promise all of that is true and stays true, and that what you tell us about your business is accurate. If your state requires your license number in ads, send it to us and we'll show it on your listing.
7. For pros: pay per lead
No subscription. We text and email you jobs as they come in. The price is shown before you claim one; it depends on the trade and the size of the job. When you claim a job you pay by card through Stripe, plus sales tax where your state charges it, and the homeowner's name and number open straight away. Each job goes to at most 2 pros. Pros in the job's city see it first; after 2 hours it may go to pros in nearby cities. Refunds follow our refund policy.
8. For pros: exclusive territory (subscription)
What you get: a territory is one trade in one guide city, for example "Plumber, Houston, TX". While you hold it, every confirmed quote request for that trade in that city goes to you and nobody else, and your featured listing shows on that city's guide. We don't promise a number of leads, jobs or a search ranking.
Price and free period: the monthly price for your trade is shown before you sign up ($149 to $499 a month). Your first 30 days are free.
Automatic renewal: after the free period, your card is charged the monthly price plus sales tax where your state charges it, automatically, every month on the same date, until you cancel. Your monthly price doesn't change while you hold the territory.
Cancel any time: in your dashboard, online, with no phone call. Cancel during the free period and you pay nothing. Cancel later and you keep the territory to the end of the month you've paid for, then it ends; we don't refund part months. We email you when you sign up, again 3 days before your free period ends, and when your territory ends.
If a payment fails, we'll ask you to update your card. If it still isn't paid, we may pause your leads or end the territory.
9. For pros: how you contact homeowners
- Contact a homeowner only about the job they asked for, and only between 8 am and 8 pm their local time.
- Call and text them yourself. Don't use autodialers, prerecorded or AI voices, or mass texting tools on them.
- Stop at once if they ask you to, or if we tell you they texted STOP to us.
- Don't add them to any mailing or marketing list, and don't sell, share or pass on their details. Keep them secure and delete them when you no longer need them for that job.
- Follow the law when you contact them and do the work, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, state telemarketing and do-not-call laws, CAN-SPAM, and your state's contractor and consumer protection laws. You are responsible for your own compliance.
- No fake reviews, false claims about your license or insurance, or high-pressure tactics.
10. For pros: listings, emails and texts
You let us show your business name, phone, website and logo on your listing and in our emails. Listings are labeled as paid, and nobody can pay to change a price. We can edit or remove a listing that is inaccurate or gets complaints.
By signing up you agree to job texts and emails at the number and email you gave. Reply STOP to stop texts; if you do, you'll stop getting jobs by text.
If we texted or emailed you about a job before you signed up: we found your business in public map data or on your website. Your first job from us is free. Replying YES, or tapping "Yes" on the job page, signs you up for pay-per-lead jobs under these terms. Reply STOP, or use the link in any email, and we won't contact you again.
11. For pros: suspension and indemnity
We can suspend or close your account if you break these terms, if homeowners complain about you, or if you abuse refunds or chargebacks. You agree to cover us (including reasonable legal fees) against claims that come from your work, how you contact homeowners, or your breaking these terms or the law.
12. Using the site
You can read our guides and link to them. Don't copy or republish our price data at scale, scrape the site, use bots, try to get into areas you're not allowed in, or interfere with how it works. The site's content, design and data belong to us. If you think something here infringes your copyright, email us.
13. Disputes: arbitration and no class actions
Talk to us first. Email hello@localgoingrate.com with your name, what happened and what you want. We'll try to fix it within 60 days.
Arbitration. If we can't fix it, you and we agree that any dispute about the site, these terms or our services will be settled by binding individual arbitration under the Federal Arbitration Act, run by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Rules for pros). The arbitration can take place online, by phone or in your county. Either of us can take a claim to small claims court instead, if it qualifies.
No class actions. Claims can only be brought individually, not as a plaintiff or class member in any class, group or representative action. If this sentence is found unenforceable for a claim, that claim goes to court instead of arbitration.
Opting out. You can opt out of this section within 30 days of first agreeing to these terms, by emailing hello@localgoingrate.com with the subject "Arbitration opt-out".
Law and courts. These terms are governed by the Federal Arbitration Act and the laws of the State of Delaware, without regard to conflict-of-law rules. Anything not sent to arbitration goes to the state or federal courts in Delaware, unless the law of your state says otherwise.
14. No warranties, limited liability
The site is provided "as is" and "as available". To the extent the law allows, we make no warranties about it, and we aren't liable for decisions made from our estimates, for work done or not done by any pro, or for indirect, incidental or consequential losses. To the extent the law allows, our total liability is limited to the greater of $100 or what you paid us in the 12 months before the claim. Some states don't allow these limits, so they may not apply to you; nothing here takes away rights your state's law gives you that can't be waived.
15. Changes and the rest
We may update these terms. We'll post the new version here with a new date, and email pros at least 30 days before a change that affects their plan. If you keep using the site after a change, the new terms apply. If part of these terms can't be enforced, the rest still applies. We can transfer these terms to a new owner of the business. These terms, the SMS terms and the refund policy are the whole agreement about the site.
